| Wedding
It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification unless agreed by both parties in writing. (the parties being Kevin Jones, Digital Imaging Wales (the Photographer) and the customer (Client).
Booking Fee
The Booking fee secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of a cancellation, it being the agreed loss suffered byDigital Imaging Wales due to cancellation. Cancellation less than 12 weeks before the wedding will result in the payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as Digital Imaging Wales can re-schedule for the new date and time.
Payments
Following payment of the booking fee, balance of fees due to be paid 75% 14 days prior to the wedding & the remaining balance on collection of the album/viewing of the Graphistudio PDF's. no photographs will be delivered until all payments due have been paid in full. Payment for additional images is to be made when they are ordered.
Display
Digital Imaging Wales may display any photographs included in this contract in the studio, portfolio, literature, display areas, exhibitions, competitions, advertising, website or slide shows.
Images
All image sizes are nominal.Digital Imaging Wales will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man made fibres. It is sometimes impossible to record on film/ digital file the eact colour as seen by the human eye.
Retouching
Retouching, digital manipulation and artist finishing is available tot he Client as an optinal extra. The Photographer will use his descretion as to charge for small blemishes and this will be outlined to the client prior to work commencing.
Reorders
All reorders shall be treated as and extension of the contract and no responsibilty for error will be accepted unless orders are given in writing.
Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1998. it is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of a contract with Digital Imaging Wales without the permission of the Photographer/s in writing.
Licence
the Photographer/s shall be granted artistic licence in relation to the poses photographed and locations used. the Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. due to the vagaities of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Force majeure or Act of God
The due performance of the contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Attendance
In the unlikely event of the assigned Photographer being unable to attend the wedding due to unforseen circumstances, we reserve the right to appoint another photographer to attend the wedding on our behalf to undertake the wedding photography to the best of his/her ability.
Limitation of Liabilty
in the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other cicumstance the liability of one party to the other shall be limited to tha total value of the contract. Neither party shall be liable for indirect or consequential loss.
Cancellation
the Client may cancel this contract at any time by giving written notice to Digital Imaging Wales but in doing so shall forfeit any monies paid. Should cancellation be received by the Digital Imaging Wales less than 10 weeks prior to the date of the ceremony The Client shall in addition pay a sum equal to 50% of the contract value. the said sum shall be payable as compensation as an estimate of the loss Digital Imaging wales would suffer.
Digital Files
All the Digital Files remain th property of Digital Imaging Wales
Prices
All prices are subject to the current rate of V.A.T. (if applicable)
Complaints
Any complaints should first be raised by the Client with Digital Imaging Wales in writing within 21 days from the receipt of images. In the unlikely event of any unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding on both parties.
Studio & Location Portraiture

Sitting Fee
Digital Imaging Wales does not presently charge a sitting fee, this may be subject to change in the future.
Deposit
At the end of a Studio or Location Photography session, and the number and size of images has been agreed between the parties, a deposit nominally 25% of the order is payable to secure the delivery and form the contract between the two parties.
Display

Studio Safety
The studio is a workplace, there will be items that could be dangerous if misused/handled or interfered with, whilst Digital Imaging Wales will ensure a safe environment within the studio, it is the Clients responsibility to ensure that all children are supervised and remain safe at all times.
Smoking
As per the recent chaneg in legislation by the Welsh Assembly Government, Smoking in the Studio is strictly forbidden, anyone smoking on the premises will be asked to extinguish the Cigarette/Cigar/Pipe or leave the premises
